Having an agreed-upon definition of character education would be useful for both researchers and practitioners in the field. However, even experts in character education disagree on how they would define it. We attempted to achieve greater conceptual clarity on this issue through a prototype analysis in which the features perceived as most central to character education were identified. In Study 1 (N = 77), we asked character education experts to enumerate features of character education. Based on these lists, we identified (...) 30 features. In Study 2 (N = 101), experts assessed which features were central to character education through a categorization task. In Study 3 (N = 166), we assessed the extent of centrality using scalar items. We conclude by offering practical advice for the development of future character education studies and programs rooted in what is deemed central to such programs. (shrink)

The present study aims to examine the relationship between the cortical midline structures (CMS), which have been regarded to be associated with selfhood, and moral decision making processes at the neural level. Traditional moral psychological studies have suggested the role of moral self as the moderator of moral cognition, so activity of moral self would present at the neural level. The present study examined the interaction between the CMS and other moral-related regions by conducting psycho-physiological interaction analysis of functional images (...) acquired while 16 subjects were solving moral dilemmas. Furthermore, we performed Granger causality analysis to demonstrate the direction of influences between activities in the regions in moral decision-making. We first demonstrate there are significant positive interactions between two central CMS seed regions—i.e., the medial prefrontal cortex (MPFC) and posterior cingulate cortex (PCC)—and brain regions associated with moral functioning including the cerebellum, brainstem, midbrain, dorsolateral prefrontal cortex, orbitofrontal cortex and anterior insula (AI); on the other hand, the posterior insula (PI) showed significant negative interaction with the seed regions. Second, several significant Granger causality was found from CMS to insula regions particularly under the moral-personal condition. Furthermore, significant dominant influence from the AI to PI was reported. Moral psychological implications of these findings are discussed. The present study demonstrated the significant interaction and influence between the CMS and morality-related regions while subject were solving moral dilemmas. Given that, activity in the CMS is significantly involved in human moral functioning. (shrink)

The VIA Classification of Strengths and Virtues is the most commonly used model of positive personality. In this study, we used two methods of model modification to develop models for two measures of the character strengths, the VIA Inventory of Strengths-Revised and the Global Assessment of Character Strengths. The first method consisted of freeing residual covariances based on modification indices until good fit was achieved. The second was residual network modeling (RNM), which frees residual partial correlations while minimizing a function (...) that penalizes more complex models. Models based on both strategies were developed for the two questionnaires. The resulting structural models were then applied to four other samples. Though both modification procedures achieved good fit in the sample used to develop the models, only RNM resulted in adequate model fit for both measures in all cross-validation samples. This finding suggests RNM is more robust against overfitting than traditional practices. Moreover, the result supports the validity of the three-factor model of character strengths with replicability. (shrink)

In this paper, I examined whether evidence from the neuroscience of morality supports the standard models of phronesis, i.e., Jubilee and Aretai Centre Models. The standard models explain phronesis as a multifaceted construct based on interaction and coordination among functional components. I reviewed recent neuroscience studies focusing on brain networks associated with morality and their connectivity to examine the validity of the models. Simultaneously, I discussed whether the evidence helps the models address challenges, particularly those from the phronesis eliminativism. Neuroscientific (...) evidence supported the importance of brain networks, i.e., the default mode, salience, and central executive functioning networks, in moral functioning in general. The findings favorably supported the multifaceted and integrative nature of phronesis proposed by the standard models. Finally, I considered how the two models could explain the mechanisms of phronesis more integratively based on neuroscientific findings. At the end of this paper, with the evidence, I proposed several practical ideas to promote the cultivation of phronesis, e.g., the consideration of coordination among components for moral functioning and the use of moral exemplars. I explored the association between components constituting the basis for moral and optimal human functioning, i.e., moral reasoning, moral identity, empathy, and purpose, via network analysis. I employed factor scores instead of composite scores that most previous studies used for better accuracy in score estimation in this study. Then, I estimated the network structure among collected variables and centrality indicators. For additional information, the structure and indicators were compared between two groups, participants who engaged in civic activities highly versus lowly. (...) The results demonstrated significant intra- and inter-scale associations in the network. The network structure was invariant across the two groups. Despite the network invariance, I found that the global connectivity between and centrality indicators of examined factors were higher among the high civic engagement group in general. I discussed the implications of the findings in research on moral functioning based on moral psychology and virtue ethics. (shrink)

Kierkegaard's Either-Or is a book about the choice between aesthetic, ethical, and religious approaches to life. I show that Either-Or also contains a proposal for philosophy of science, and in particular, about the ideal epistemic state for human beings. Whereas the Cartesian-Hegelian tradition conceived of the ideal state as one of detached deliberation -- i.e. "seeing the world as it is in itself" -- Kierkegaard envisions the ideal state as the achievement of equilibrium between the "spectator" and "actor" aspects of (...) the human being. Kierkegaard's proposal thus sets the stage for Niels Bohr's "epistemological lesson of quantum mechanics". (shrink)

The objective of this report is twofold. In the first place it aims to demonstrate that a four-dimensional local U(1) gauge invariant relativistic quantum mechanical Dirac-type equation is derivable from the equations for the classical electromagnetic field. In the second place, the transformational consequences of this local U(1) invariance are used to obtain solutions of different Maxwell equations.

In fMRI research, the goal of correcting for multiple comparisons is to identify areas of activity that reflect true effects, and thus would be expected to replicate in future studies. Finding an appropriate balance between trying to minimize false positives (Type I error) while not being too stringent and omitting true effects (Type II error) can be challenging. Furthermore, the advantages and disadvantages of these types of errors may differ for different areas of study. In many areas of social neuroscience (...) that involve complex processes and considerable individual differences, such as the study of moral judgment, effects are typically smaller and statistical power weaker, leading to the suggestion that less stringent corrections that allow for more sensitivity may be beneficial, but also result in more false positives. Using moral judgment fMRI data, we evaluated four commonly used methods for multiple comparison correction implemented in SPM12 by examining which method produced the most precise overlap with results from a meta-analysis of relevant studies and with results from nonparametric permutation analyses. We found that voxel-wise thresholding with family-wise error correction based on Random Field Theory provides a more precise overlap (i.e., without omitting too few regions or encompassing too many additional regions) than either clusterwise thresholding, Bonferroni correction, or false discovery rate correction methods. Procura romper com o exclusivismo da teoria da produção e representação da estética tradicional, considerando a literatura como produção, recepção e comunicação, em uma relação dinâmica entre autor, obra e público, e estabelecendo, pela reconstrução do processo de recepção e de seus pressupostos, a dimensão histórica da pesquisa literária. Nesta coletânea, foram reunidos trabalhos dos teóricos mais expressivos da estética da recepção.

Context: Consistency of mathematical constructions in numerical analysis and the application of computerized proofs in the light of the occurrence of numerical chaos in simple systems. Purpose: To show that a computer in general and a numerical analysis in particular can add its own peculiarities to the subject under study. Hence the need of thorough theoretical studies on chaos in numerical simulation. Hence, a questioning of what e.g. a numerical disproof of a theorem in physics or a prediction in numerical (...) economics could mean. Method: An algebraic simple model system is subjected to a deeper structure of underlying variables. With an algorithm simulating the steps in taking a limit of second order difference quotients the error terms are studied at the background of their algebraic expression. Results: With the algorithm that was applied to a simple quadratic polynomial system we found unstably amplified round-off errors. The possibility of numerical chaos is already known but not in such a simple system as used in our paper. The amplification of the errors implies that it is not possible with computer means to constructively show that the algebra and numerical analysis will ‘on the long run’ converge to each other and the error term will vanish. The algebraic vanishing of the error term cannot be demonstrated with the use of the computer because the round-off errors are amplified. In philosophical terms, the amplification of the round-off error is equivalent to the continuum hypothesis. This means that the requirement of (numerical) construction of mathematical objects is no safeguard against inference-only conclusions of qualities of (numerical) mathematical objects. Unstably amplified round-off errors are a same type of problem as the ordering in size of transfinite cardinal numbers. The difference is that the former problem is created within the requirements of constructive mathematics. This can be seen as the reward for working numerically constructive. (shrink)

In the following the details of a state-of-affairs semantics for positive free logic are worked out, based on the models of common inner domain - outer domain semantics. Lambert's PFL system is proven to be weakly adequate (i.e., sound and complete) with respect to that semantics by demonstrating that the concept of logical truth definable therein coincides with that one of common truth-value semantics for PFL. Furthermore, this state-of-affairs semantics resists the challenges stemming from the slingshot argument since logically equivalent (...) statements do not always have the same extension according to it. Finally, it is argued that in such a semantics all statements of a certain language for PFL are state-of-affairs-related extensional as well as salva extensione extensional, even though their salva veritate extensionality fails. Introduction The Defining Issues Test (DIT) aimed to measure one’s moral judgment development in terms of moral reasoning. The Neo-Kohlbergian approach, which is an elaboration of Kohlbergian theory, focuses on the continuous development of postconventional moral reasoning, which constitutes the theoretical basis of the DIT. However, very few studies have directly tested the internal structure of the DIT, which would indicate its construct validity. Objectives Using the DIT-2, a later revision of the DIT, we examined whether a bi-factor model or (...) 3-factor CFA model showed a better model fit. The Neo-Kohlbergian theory of moral judgment development, which constitutes the theoretical basis for the DIT-2, proposes that moral judgment development occurs continuously and that it can be better explained with a soft-stage model. Given these assertions, we assumed that the bi-factor model, which considers the Schema-General Moral Judgment (SGMJ), might be more consistent with Neo-Kohlbergian theory. Methods We analyzed a large dataset collected from undergraduate students. We performed confirmatory factor analysis (CFA) via weighted least squares. A 3-factor CFA based on the DIT-2 manual and a bi-factor model were compared for model fit. The three factors in the 3-factor CFA were labeled as moral development schemas in Neo-Kohlbergian theory (i.e., personal interests, maintaining norms, and postconventional schemas). The bi-factor model included the SGMJ in addition to the three factors. Results In general, the bi-factor model showed a better model fit compared with the 3-factor CFA model although both models reported acceptable model fit indices. Conclusion We found that the DIT-2 scale is a valid measure of the internal structure of moral reasoning development using both CFA and bi-factor models. In addition, we conclude that the soft-stage model, posited by the Neo-Kohlbergian approach to moral judgment development, can be better supported with the bi-factor model that was tested in the present study. The world is occupied by many and varied things. What constitutes their thingness? In the Essay, Locke addresses this question in Book II, Chapter xxiii, titled ‘Of our Complex Ideas of Substance’, wherein the much-contested definition of ‘substratum’ appears—‘a supposed but unknown support of the Qualities’. Most significant in this definition are the dual qualifiers that Locke uses: ‘supposed’ and ‘unknown’. This paper examines this two-qualifier definition, illuminating the historical and philosophical significance it may have. There have been two rival (...) readings. The first takes Locke’s substratum to be a bare substratum; and the second identifies it with what Locke terms as ‘real essence’—i.e. ‘a real Constitution of the insensible Parts’. Critically reviewing these two major interpretations, I attribute to Locke a type of functionalism, according to which the status of a substratum is determined by its functional role of ‘uniting’ a bundle of qualities into an individual substance. This paper reconsiders Ockham's critique of the species theory of cognition. As Ockham understands this theory, it says that the direct objects of cognition are mental representations, or species. According to many commentators, one of Ockham's main objections to this theory was that, if the direct objects of cognition are species rather than external objects, we will never be able to establish whether or not a given species is a veridical representation of the world. In this paper I argue that (...) this line of interpretation sits uneasily with Ockham's epistemology, and offer a new interpretation of Ockham's critique of species. (shrink)

This essay examines an ambiguity in Hans Kelsen’s theory of a norm. On the one hand, Kelsen claims to adhere to what he considers the ‘is/ought’ dichotomy. Kelsen claims that he is describing what really is. On the other hand, Kelsen seems to be understanding the is/ought dichotomy in a very different manner than that by which his contemporaries or, indeed, today’s readers understand the distinction. The clue to this ambiguity is Kelsen’s understanding of a norm. Although legal existence (...) is said to rest with norms, this existence is very different than an existence constituted from social behaviour. Instead, in Kelsen’s view, a norm is a signifying relation between a sign and a cognitive object. Kelsen’s theory of language, however, is very different from a theory of speech acts. When addressing why a norm is binding, we find that Kelsen’s full theory of language excludes important phenomena in order to retain its purity. (shrink)

The biochemistry of geotropism in plants and gravisensing in e.g. cyanobacteria or paramacia is still not well understood today [1]. Perhaps there are more ways than one for organisms to sense gravity. The two best known relatively old explanations for gravity sensing are sensing through the redistribution of cellular starch statoliths and sensing through redistribution of auxin. The starch containing statoliths in a gravity field produce pressure on the endoplasmic reticulum of the cell. This enables the cell to sense direction. (...) Alternatively, there is the redistribution of auxin under the action of gravity. This is known as the Cholodny-Went hypothesis [2], [3]. The latter redistribution coincides with a redistribution of electrical charge in the cell. With the present study the aim is to add a mathematical unified field explanation to gravisensing. Description Logics (DLs) are a family of well-known terminological knowledge representation formalisms in modern semantics-based systems. This research focuses on analysing how our developed Occurrence Logic (OccL) can conceptually and logically support the development of a description logic. OccL is integrated into the alternative theory of natural language syntax in `Deviational Syntactic Structures' under the label `EFA(X)3' (or the third version of Epi-Formal Analysis in Syntax, EFA(X), which is a radical linguistic theory). From the logical point of view, OccL is (...) a formal logic that mainly deals with the occurrences of symbols as well as with their priorities within linguistic descriptions, i.e. natural language syntax, semantics and phonology. In this article---based on our OccL-based definitions of the concepts of `strong implication' and `occurrence value' as well as of the logical concept `identical occurrence constructor (IDOC)' that is the most fundamental logical concept in our formalism---we will model Occurrence Description Logic ($\mathcal{ODL}$). Accordingly, we will formally-logically analyse `occurrence(s) of symbol(s)' within descriptions of the world in $\mathcal{ODL}$. In addition, we will analyse and assess the logical concepts of `occurrence' and `occurrence priority' in $\mathcal{ODL}$. This research can make a strong logical background for our future research in the development of a Modal Occurrence Description Logic. (shrink)

Free logics aim at freeing logic from existence assumptions by making them explicit, e.g., by adding an existence premisse to the antecedence of the classical axiom-schema of Universal Instantiation. Their historical development was motivated by the problem of empty singular terms, and that one of simple statements containing at least one such singular term: what is the referential status of such singular terms and what truth-value, if any, do such statemants have? Free logics can be classified with regard to their (...) respective answers to these problems. Negative free logics assume that non-existent objects cannot have any properties at all; hence, in particular, they cannot be self-identical or rotate. Positive free logics believe that non-existents can be self-identical according to the Leibnizian concept of identity. Neutral free logics think that statements of self-identity are truth-valueless because of the Fregean principle of compositionality. Since only in negative free logic, but not in positive free logic, two statements of the forms "a = a" and "E!a" are logically equivalent, one also can define only for NFL, but not for PFL, existence by self-identity. Kapitalist Toplum, Politika, Rasyonalite. -/- Rationality, Experience and Knowledge in the Age of Technology: Problems & Criticisms -/- Abstract -/- The question of how human potential is imprisoned in contemporary capitalism is one of the central topics of the analysis on social reality by every social theory which claims to be critical. This question which can be concretized as a systematic occupation with the cultural-technical forms which caused by contemporary capitalism and as an analysis of new types of social subjectivity which emerge as a result of these forms, essentially includes the effort to specify at what level and by using what kind of tools the current system grabs the individual by the throat. Frankfurt School tradition as one of the foremost traditions which conducts such an investigation, discusses the analysis of society over fragility of the bourgeois individual. -/- According to Frankfurt School, the individual in contemporary capitalism is extorted from bourgeois ideals and is out of breath as a result of blockade of overgrown structures in social context in which s/he lives. In other words, the bourgeois individual has been erased. In the late capitalist society where personal histories are melted away, technological progress is one of the processes that led to the deletion of the individual. The clearest expression of this emphasis finds correspondence in the introduction of Herbert Marcuse's One Dimensional Man. Marcuse proposes two opposite theses in this work which he examines advanced industrial societies: 1) Advanced industrial society have a structure that it can control the qualitative changes in predictable future, 2) However, trends and forces which can reverse this situation (which can break this limitation and destroy capitalist society) also exist. First one claims that relations of domination in the social structures are sustainable in the future; and the other thesis emphasizes that the opportunity of emancipation of people by getting free of these power relations is still possible. However, Marcuse does not dwell on too much on the latter (which is the claim about possibility of powers and trends that can change the current situation). Moreover it could be argued that his arguments relating to technological rationality and one-dimensionality draws us into the impossibility of attaining any moment of a positive social transformation. -/- The book is dominated by an atmosphere of immense feeling of being encircled and hopelessness, thus it follows from the work of Marcuse that in the system that we live in it is even impossible to breathe freely. Although in follow-up studies after the One Dimensional Man (especially in writings in which vitality of 68 movement and the axis of New Left), it can be observed that there is an attempt to convert despair into hope, it is clear that Marcuse’s designations regarding technological life mechanisms should be discussed again given the technological advancements of our times. Within this context, in the study, how the technology affects and furthermore determines the individuals and society as a whole in the modern industrial societies has been investigated. This investigation has been carried out through Herbert Marcuse's views on technology which are presented in his work One-Dimensional Man. The relationship between rationality, knowledge and experience has been examined on the basis of technology, and then Marcuse's concept of ‘technological rationality’ has been analysed in the context of Claus Offe's criticisms. -/- Finally, Marcuse's critique of technology has been assessed by considering the emerging social practices in this day and time. Herbert Marcuse refers to the rationality which is created by technology and is directly based on submissive efficiency, as ‘technological rationality’. Thinker argues that what is considered to be rational in a society is subject to change with technological developments, and social rationality is directly connected to the technological advancements. There are three different projections of technological rationality approach which are in turn ontological, epistemological and ethicalpolitical approaches. Claus Offe claims that it is possible to group these different dimensions under three theses. According to the first one; scientific rationality has become the organizational principle of domination. -/- According to Offe, in his second thesis Marcuse mentions the emergence of technology sui generis i.e. as a distinctive autonomous technological rationality. And the third thesis proceeds on the line of the argument that socialist societies are under the impact of technological rationality as well as capitalist societies. According to Offe, even though these three theses are consistent with each other, Marcuse has been violated the most fundamental principle of the Critical Theory by not offering any possibility of social transformation which are aimed at the problems of extensive manipulation and pacified existence that brought about by technological rationality. Hence although Marcuse's work is of utmost importance with regard to his analysis and the issues that he has covered, it would not be wrong to say that a problematic argument from the point of the tradition of Critical Theory has been proposed. The main reason for this is the argument which asserts that the technology turned into a mechanism of domination which is almost irreversible and unchangeable. Therefore, such mechanism does not offer any resistance point where human can take a breath. As a result of this, emancipation which is the main political purpose of the Critical Theory has been invalidated. What could be the problems which are created by the negative situation that results from Marcuse's thesis on technology? For instance, how could the basis for the existence of opposing movements which are organized over the internet or the foundations of anti-capitalist radical critique be explained on the axis of Marcuse’s thesis? -/- There is a fundamental problem that has to be solved: if we declare only the validity of oppressive, central and ideological functions of technological devices, then the idea which is referred by authoritarian governments that current opposing movements or rebel groups organized over internet might be organized from a centre which is defined as imperialist power or external power becomes an affirmable argument. In other words, does Marcuse's technological determinist approach serves to legitimize the discourses such as "foreign powers or imperialist enemies," and so on which authoritarian powers frequently resort to. Is it possible to think of another alternative with regard to the problems produced by this rationality apart from the negative comments that revealed by the concept of technological rationality. The extent to which individuals with a variety of cultural backgrounds differ in empathic responsiveness is unknown. This article describes the differences in trait empathy in one independent and one interdependent society (i.e., the US and Iran, respectively). The analysis of data collected from self-reported questionnaires answered by 326 adults indicated a significant difference in the cognitive component of empathy concerning participants’ affiliation to either egocentric or socio-centric society: Iranian participants with interdependent cultural norms, reported higher cognitive empathy compared to (...) American participants who share independent cultural norms. In line with previous studies, gender differences were observed in all subscales of questionnaires, except the Empathy Quotient (EQ). Female participants demonstrated more empathy than males in both samples. Implications for understanding the cross-cultural differences of various components of empathy are discussed. (shrink)

Research results indicates that the LASSO model identifies 5 financial indicators affecting financial risks which risky businesses faced during 5 years (2017-2021), they are Short-term solvency ratio (Short-term assets/Short-term liabilities); Total asset turnover (Net revenue/Total assets); ROA (Profit after tax/Total assets); Long-term debt to total asset ratio; Short-term debt to total debt ratio. The discovery of a letter in the Niels Bohr archives written by Bohr to a Danish schoolteacher in which he reveals his early knowledge of the Daodejing led the present author on a search to unveil the influence of the philosophy of Yin-Yang on Bohr's famed complementarity principle in Western physics. This paper recounts interviews with his son, Hans, who recalls Bohr reading a translated copy of Laozi, as well as Hanna Rosental, close friend and associate who also confirms (...) the influence of ancient Chinese philosophy on this major figure in Western physics. As with Bohr’s dual perspective approach to the wave-particle, in which describing matter as either wave or particle is not considered inherently contradictory, this article likewise argues that Eastern and Western perspectives about philosophy, reality and life in general need not antagonize one another as is the case in Hegelian dialecticism. Through developing a globally accessible, harmonized system of Eastern and Western thought, this article suggests that individuals can more easily overcome limitations arising from cultural singularity in conventional philosophical approaches and, in turn, achieve a greater degree of social harmony and depth of philosophical understanding, all in the same stroke. In spite of his post-World War II works on international law, which seems more purely juridical, Hans Kelsen continues to put forward in his vast body of work an implicit – and sometimes even explicit – juridical objectivism and pacifism. Especially before and during the second World War he makes – by means of many moral-political writings – an effort for a more effective assurance of international peace. The fact that Kelsen regards the law as the pre-eminent means to (...) achieve the end of peace, is – in view of the tradition running from Hobbes to Kant – still not very innovating. But the primary and central role he assigns to the judiciary in order to guarantee international peace is on the other hand really original. To bring out Kelsen’s juridical objectivism and pacifism, I restrict myself in this article to his plea before and during the second World War for the judicial primacy in the international legal order. In that plea, which is spread over many writings and founded by several arguments, I distinguish however three main convincing arguments – namely an evolutionary, a technical and a moral-political argument – for the establishment of an international court with compulsory jurisdiction as the ‘guardian of international peace’. The fact that Kelsen’s original plea is still relevant to our times, is already evident from the post-World War II UN-system of peace-enforcement, which still functions little satisfactorily and of which the existing plans of reform go no further than strengthening the position of the Security Council, the current hardly effective ‘maintainer of world peace’. I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. This paper aims to analyze the metaphorological project of Hans Blumenberg in relation to the philosophical developments of conceptual history in the mid-twentieth century. It is argued that Blumenberg, based on the study of metaphor, seeks to endow philosophy with a historical substrate that gives rise to the concept, forgotten by the inheritance of the cartesian philosophy. A presente dissertação tem como tema central a proposta da abordagem hermenêutica da decisão judicial em Hans Kelsen considerando seu relativismo filosófico. No primeiro momento expõe a concepção de decisão judicial no autor e as suas reformulações conceituais no decorrer das suas obras – as passagens do formalismo normativista das primeiras obras até o ceticismo de regras na Teoria geral das normas. Também propõe a dissolução entre as leituras formalistas e realistas através da possibilidade de uma leitura realista moderada. (...) Após expõe a filosofia relativista do autor e seu resultado na exclusão dos elementos da moralidade do conceito de direito. Finalmente deduz regras de interpretação a partir de uma visão abrangente das obras do autor. O objetivo da dissertação, nesse sentido, é analisar a dinâmica da criação normativa pelo judiciário, a discricionariedade daí resultante e a possibilidade de interpretar os vários sentidos das normas sem recorrer a qualquer moralismo para tal. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

To what extent can Nietzsche's idea of the Overman be used in connection with transhumanist notions of highly advanced humans and even posthumans?

A teoria do Direito internacional de Kelsen é monista, ou seja, o autor reúne a legislação nacional e internacional em um único sistema normativo. Com isso, descarta o dualismo e promove uma tese fundada no princípio lógico da não-contradição, traduzido juridicamente para o princípio da imputação. Por essa afirmação, o Direito internacional, considerando o primado estadual, existe a partir do reconhecimento interno da validade da legislação externa; mais, a recepção dos acordos internacionais na legislação nacional acopla internamente o Direito internacional, (...) com seus tratados bi/multilaterais, pactos, instituições, costumes e tribunais. A teoria de Kelsen torna-se complexa, porém, quando, indagando o inverso dessa premissa, o Direito internacional posto e eficaz, já inserido internamente, não reconhece a validade normativa de eventual interpretação ou norma interna e atua como agente determinante da ordem jurídica nacional. Com isso, o Direito externo torna-se decisivo desse mesmo sistema jurídico interno, não necessariamente por uma ação coercitiva, mas por intermédio do seu reconhecimento da validade da legislação interna. Vimos esse fenômeno materializar-se no caso dos dois presidentes simultâneos da Venezuela: tanto o presidente Nicolás Maduro, quando o presidente Juan Guaidó, foram formalmente designados, por países e instituições distintas, como governantes válidos. Sendo assim, o objetivo do livro consiste em compreender esse fenômeno de reconhecimento externo dos sistemas normativos nacionais através da segunda edição da Teoria de pura do Direito como marco teórico. Igualmente, utiliza-se do estudo de caso sobre a determinação do presidente válido da Venezuela como elemento empírico e de falseabilidade. Com isso, defende a hipótese da necessidade do reconhecimento normativo-objetivo do Estado a partir da formação do Direito internacional, independentemente de seu primitivismo. Os quatro primeiros capítulos, na primeira seção, estabelecem uma interpretação sobre a obra de Kelsen, focada em seu aspecto internacionalista. Nos quatro últimos, na seção II, submeto as conclusões teóricas ao caso concreto, falseando-as ou não conforme seu teste empírico. (shrink)

The article deals with present day challenges related to the employ of technology in order to reduce the exposition of the human being to the risks and vulnerability of his or her existential condition. According to certain transhumanist and posthumanist thinkers, as well as some supporters of human enhancement, essential features of the human being, such as vulnerability and mortality, ought to be thoroughly overcome. The aim of this article is twofold: on the one hand, we wish to carry out (...) an enquiry into the ontological and ethical thinking of Hans Jonas, who was among the first to address these very issues with great critical insight; on the other hand, we endeavour to highlight the relevance of Jonas’ reflections to current challenges related to bioscience and biotechnological progress. In this regard, we believe that the transcendent and metaphysical relevance of the «image of man» introduced by Jonas is of paramount importance to understand his criticism against those attempts to ameliorate the human being by endangering his or her essence. English title: Gadamer's interpretation of the Aristotelian Protrepticus. -/- Abstract: The aim of this paper is to present and analyse the main hypotheses of Hans-Georg Gadamer in his 1928 essay Der aristotelische Protreptikos und die entwicklungsgeschichtliche Betrachtung der aristotelischen Ethik, emphasizing the Gadamerian reception of the notions of phrónēsis, hēdonḗ and, to a lesser extent, phýsis. It will be attempted to show that in this early work of Gadamer there is more than a methodological and interpretative debate regarding the (...) Protrepticus and the Aristotelian ethics. Lastly, the paper argues that it is possible to read in the main arguments of this early essay the first intellectual maturation of relevance of Gadamer, expressed in the form of a critical dialogue with his great masters (Paul Natorp, Nicolai Hartmann, Martin Heidegger, Paul Friedländer), departing from the new interpretative possibilities that philology and phenomenology opened to his studies on the ethical-political philosophy of Plato and Aristotle. The theoretical consequences of this early article would have both paved the way of Gadamer’s next theoretical interventions regarding Platonic political philosophy as well as for the future developments of philosophical hermeneutics. /// -/- Resumen: El objetivo de este artículo es presentar y analizar las principales hipótesis de Hans-Georg Gadamer en su ensayo de 1928 Der aristotelische Protreptikos und die entwicklungsgeschichtliche Betrachtung der aristotelischen Ethik, poniendo énfasis en la recuperación gadameriana de las nociones de phrónēsis, hēdonḗ y, en menor medida, phýsis. Se intenta demostrar que en este trabajo temprano de Gadamer hay, en términos metodológicos e interpretativos, más que una discusión con Werner Jaeger con relación al Protréptico y a la ética aristotélica. Finalmente, este artículo sostiene que es posible leer en las principales argumentaciones del ensayo la primera maduración intelectual de relevancia de Gadamer, expresada en forma de diálogo crítico con sus grandes maestros (Paul Natorp, Nicolai Hartmann, Martin Heidegger, Paul Friedländer), a partir de las nuevas posibilidades interpretativas que la filología y fenomenología le abrieron para el estudio de la filosofía ético-política de Platón y Aristóteles. Las consecuencias teóricas de este temprano artículo habrían signado tanto el camino de sus siguientes intervenciones teóricas en tono a la filosofía política platónica como también los futuros desarrollos de la hermenéutica filosófica. Il pensiero di Hans Jonas, specie per quel che riguarda la cosiddetta “biologia filosofica”, tratta indirettamente del rapporto tra essere umano e animale. A questo riguardo, Jonas rifiuta sia l’approccio dualistico, sia quello monistico-riduzionistico e propende al contrario per una complessiva reinterpretazione del fenomeno della vita nei termini di quel che egli definisce una “rivoluzione ontologica”. In virtù di ciò, il pensatore rintraccia lo specifico del fenomeno della vita e individua nelle forme viventi una scala naturae di complessità, auto-trascendimento (...) e libertà via via crescenti, le cui tappe significative sono la vita organica, quella animale e quella umana. Per quel che concerne la forma animale, varie specie presentano “potenzialità trans-animali”, che evidenziano un ponte biologico e ontologico verso l’essere umano. In altre parole, l’animale è in qualche modo in grado di prefigurare la forma di vita specificamente umana. Tuttavia, sostiene Jonas, non appena quest’ultima fa la propria comparsa, essa è tale per cui se ne evidenzia al tempo stesso anche lo “iato metafisico” rispetto alla vita animale. La specificità umana si manifesta nella propria capacità di essere responsabile e di preservare le condizioni basilari per una vita autentica sul pianeta. (shrink)

● Este ensayo corre el velo de una estrecha relación entre los símbolos astrológicos y el mundo fenoménico y explica cómo dicotomías características de los siglos XVIII y XX han dificultado esta y otras comprensiones de nuestra realidad. ● Las observaciones se apoyan en los hallazgos producidos durante los últimos cuarenta años con relación a los planetas, sus características astronómicas y propiedades astrofísicas, hallazgos que corroboran casi integralmente los esbozos que sobre los planetas hiciera, entre otros autores, VETIO VALENTE (s. (...) II a.C.) en su afamada Antología. ● Como el sol alcanza su mayor fuerza durante el verano y su menor fuerza durante el invierno, también el resto de los miembros de nuestro sistema solar cobran fuerzas en diferentes segmentos de la eclíptica, contribuyendo en matices específicos de las condiciones del clima en diferentes épocas, lo que nutre las significaciones (o propiedades) zodiacales. ● Apoyándonos en hechos constatados por la física y el magnetismo molecular, defendemos la eclíptica (Zodiaco) como una realidad físico química cuyos doce segmentos afianzan o menoscaban el poder aparentemente electromagnético de algunos planetas con relación a la Tierra en diferentes épocas según la revolución solar de cada uno. ● Con el fin de favorecer la comprensión, prejuicios comunes necesitan ser tratados, y de ahí los tres acápites que componen la introducción del ensayo, uno de los cuales aborda un recurso del lenguaje, la alegoría, con el fin de demostrar su recurrente necesidad tanto en el pasado como en el presente sin que dicha práctica constituya una infidelidad fenoménica. ● Por último, ofrecemos la explicación más plausible producida hasta ahora sobre el mecanismo de acción responsable de la astrología, es decir, de la influencia de los cuerpos celestes (más allá de la luna y del sol) sobre la vida en la Tierra: «quantum entanglement», o la “acción misteriosa a distancia” incrédulamente formulada por EINSTEIN en 1935, cuya comprobación les ganó el Premio Nobel de Física 2022 a ANTON ZEILINGER y JOHN CLAUSER. ● Utilizamos un número considerable de ilustraciones a los fines de apoyar la comprensión del lector, que puede no ser astrólogo sino un curioso, y esperamos que sean más los curiosos que los astrólogos, especialmente si hacen parte de la comunidad científica. Between Timelessness and History: The Image of the Human Being in Hans Jonas’ Ethics. This essay offers a contribution to the inquiry into the notion of image of the human being in Hans Jonas’ ethics. More specifically, passages from Das Prinzip Verantwortung and Technik, Medezin und Ethik are discussed to shed light on the complex temporal character that the image exhibits, stretched between the atemporality of what is equal to itself and the vulnerability that is distinctive of historical (...) time. Particular attention is dedicated to the fact that Jonas depicts the image as cross-cutting usual dichotomies such as temporal and timeless, permanent and changing, historical and non-historical – perhaps even transcendent and immanent. Albeit within its limits, the present work identifies the paradoxical temporal character of the image and, in so doing, points to a middle way between essentialism and relativism that may help rethink the relation between ethical values and historical time. The book focuses on the thinking of the philosopher of Jewish origins, Hans Jonas (1903-1993), and precisely on his “philosophical biology”. The overall thesis is that this topic, which occupies the second stage of his thinking, is coherent with the previous phase (which focused on ancient Gnosticism), as well as with the following (which was dedicated to the ethics of responsibility). The main evidence supporting this thesis is the key notion of “ontological revolution”, the development of which I try (...) to analyse in Jonas’ published and unpublished writings. This is the first innovative feature of the research. The second is my attempt to compare Jonas’ ideas of life and organism with the reflections of thinkers such as Aristotle, Spinoza, and Whitehead. Il pensiero di Hans Jonas è comunemente inteso nel segno di una netta reazione all’interpretazione gnostica del sé e del mondo. Egli si dedicò allo studio della gnosi dalla metà degli anni venti fino al secondo dopoguerra, e il frutto delle sue ricerche è raccolto nei due volumi di Gnosi e spirito tardoantico (1934, 1964). Questa lettura polemica della sua filosofia è davvero in grado di rendere conto dei rapporti che la proposta jonasiana, come filosofia della biologia e etica (...) della responsabilità, intrattiene con le strutture caratteristiche del mito gnostico? Attraverso una approfondita analisi de Il concetto di Dio dopo Auschwitz, momento nel quale l’approccio unitario della filosofia jonasiana è più evidente, possono essere ritrovati i segni di un confronto positivo con la gnosi. Anche i caratteri del pensiero gnostico, dunque, concorrono a guidare la ricerca di Hans Jonas verso i temi propri della sua riflessione matura. (shrink)

Dessa discriminação entre o ser e o dever-ser há o principal argumento do autor para a separação do direito das ciências causais e, principalmente, a superação da falácia naturalista no âmbito teórico e moral. Nesse sentido, também o artigo se propôs a analisar a refutação de (...) In questo saggio si propone una lettura congetturale delle brevi note sulla questione dell’utilità del pensiero filosofico che Hans Jonas appunta in chiusura della conferenza Sulle cause e gli usi della filosofia (1955). A tal fine mi rivolgo innanzitutto alla ricostruzione dell’etica socratica che Jonas elabora nello scritto Virtù e saggezza in Socrate e in seconda battuta alla discussione della dottrina della scienza di Bacon abbozzata in Prospettive filosofiche sulla rilevanza della conoscenza per l’uomo e poi ripresa in scritti (...) successivi. In conclusione offro una ricostruzione dell’idea jonasiana dell’utilità della filosofia come scienza dell’immagine dell’uomo e mostro come tale approccio possa essere significativo anche e soprattutto nell’attuale età tecnologica. -/- English: In this essay I submit an hypothetical reading of the short notes concerning the practical use of phi-losophy which Hans Jonas wrote down at the end of the manuscript Of the causes and uses of phi-losophy. In order to do that, I focus the attention on Socratic Wisdom and Virtue first, where Jonas discussed Socrate’s ethics, and secondly on Jonas’s critique to Francis Bacon's doctrine of science, which he sketched in Some philosophers’ views on the human relevance of knowledge and devel-oped in later writings. My aim is to try and reconstruct Jonas’s ideas concerning the practical value of philosophy as the science of the image of man and to show how this may be relevant to our technological age. (shrink)

Embora elaborada principalmente na década de 1970 a ética de Hans Jonas permanece atual e é particularmente relevante pelo uso da metafísica em um contexto pós-moderno (algo inusitado e ousado) e por sua teoria dos valores que podem ser atribuídos ao ser e ao não-ser. Pretende-se aqui apresentar as limitações que Jonas detectou nas éticas tradicionais (judaico-cristã, kantiana, por exemplo) e analisar as soluções por ele propostas (notadamente heurística do medo e futurologia comparada). Compreender também a fundamentação de tais (...) soluções (um dos maiores desafios da ética jonasiana). A pesquisa baseou-se em uma revisão bibliográfica que envolve a fonte primária, a obra de Jonas, e fontes secundárias. Constatou-se que a ética de Jonas surge da detecção de um niilismo tanto prático quanto teórico que permitiu um avanço desenfreado da técnica. É necessário então submeter a atividade humana à ética novamente. Para tanto foi utilizada uma ontologia que atribui relevância ética ao metabolismo (e não à razão). Deste modo, a ética da responsabilidade objetiva combater o niilismo e o ceticismo moral e supervisionar o progresso técnico, garantindo assim a existência de uma vida humana autêntica e de uma natureza que tem a si própria como fim. A comparison between the thinking of Hans Jonas and Joseph Ratzinger on Darwinism and Intelligent Design.

Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.

A separação entre o ser, isto é, o ato, e o dever-ser, ou seja, o sentido de comando, permissão etc.. do ato é parte fundamental para o entendimento da epistemologia proposta por Hans Kelsen. Dessa discriminação entre o ser e o dever-ser há o principal argumento do autor para a separação do direito das ciências causais e, principalmente, a superação da falácia naturalista no âmbito teórico e moral. Nesse sentido, também o artigo se propôs a analisar a refutação de (...) Este artigo constitui uma reflexão acerca desta central e controversa afirmação contida na terceira parte de Verdade e Método segundo a qual "ser que pode ser compreendido é linguagem". Depois de apresentar uma tríplice leitura dessa mesma afirmação, concretamente na sua dimensão platónica, kantiana, e hegeliana, o artigo procura sobretudo desenvolver uma leitura ontológica da mesma. É assim que, partindo dessa tríplice leitura, o presente trabalho intenta justificar e fundamentar a Ontologia hermenêutica de Gadamer, a qual considera ser, para além (...) de diferente, mais autêntica que a Onto-teologia aristotélica e a Ontologia fundamental heideggeriana. Dessa forma, o artigo intenta fazer, a partir da obra de Hans-Georg Gadamer, uma descrição da Hermenêutica filosófica a partir da afirmação segundo a qual "ser que pode ser compreendido é linguagem". /// Aim of the present article is to reflect upon this central and controversial statement, taken from the third part of Truth and Method, according to which "being that can be unterstood is language". After presenting three possible readings of the above mentioned statement, namely the Platonic, the Kantian, and the Hegelian, the article proceeds to develop an onto logical reading of the same passage. Thus, on the basis of these readings, the article both justifies and grounds the gadamerian hermeneutical ontology, which it considers as being different from and more authentic than both the Aristotelian onto-theology and the Heideggerian fundamental ontology. The paper, finally, describes how the notion of philosophical Hermeneutics, as it is found in the work of Hans-Georg Gadamer, is summarized in the affirmation according to which "being that can be unterstood is language". O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. El marco ontológico presente es resultado de un desplazamiento que va del ocaso de las cosas al consumo rápido y frenético de no-cosas. En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. This paper focuses on an early Chinese conception of genealogical argumentation in the late Warring States text Han Feizi and a possible response it has to the problem of genealogical self-defeat as identified by Amia Srinivasan —i.e., the genealogist cannot seem to support their argument with premises their interlocutor or they themselves can accept, given their own argument. The paper offers a reading of Han Fei’s genealogical method that traces back to the meditative practice of an earlier Daoist text the (...) Zhuangzi and its communicative strategy, providing a conception of genealogy aimed at undoing fixations on political systems in order to bring about a more adaptive state—specifically, genealogy that does not require epistemological commitment to its premises. Che cosa distingue, concettualmente, l’esattore delle tasse che esiga da un uomo, a pena di sanzioni, una determinata somma di denaro, dal bandito che gli intimi, sotto la minaccia di un’arma, di consegnargli la medesima somma? È sul soddisfacimento del requisito della giustizia che si fonda, come sostenne Agostino, l’eterogeneità tra uno Stato e un’accolita di furfanti? «Se non è rispettata la giustizia, che cosa sono gli Stati, se non delle grandi bande di ladri? Perché le bande di briganti che (...) cosa sono, se non dei piccoli Stati?». Il volume ripercorre le risposte più autorevoli fornite nel XX secolo, entro un orizzonte postmetafisico, alla domanda agostiniana: prima dell’avvento del regime nazista, la tesi che un’associazione a delinquere sia indistinguibile da uno Stato è stata sostenuta da Benedetto Croce, Santi Romano e Hans Kelsen; dopo l’esperienza del nazismo e delle sue atrocità, perpetrate in nome dello Stato e della legge, le questioni relative alla natura del diritto e alla relazione tra morale e diritto hanno assunto – come ha osservato Robert Alexy – «l’urgenza di un problema scottante», e la domanda filosofica sulla validità della legge ingiusta è apparsa ineludibile non solo ai maggiori filosofi del diritto (Herbert L.H.
